TERMS AND CONDITIONS OF USE OF THE SITE.

The terms of use that are presented below (hereinafter the TERMS OF USE) are an agreement between Instituto Educativo del Noroeste, A.C. (hereinafter CETYS Universidad) and any user of WEBSITE at the electronic address: www.cetys.mx (hereinafter the SITE).

The use of the SITE by any person, attributes the quality of user (hereinafter, the USER) and it is a full time relationship which constitutes the adherence of the USER to this TERMS OF USE. Therefore the USER is aware that it is bound to this TERMS OF USE  and its modifications that it may have, every time you access the SITE. In addition, it is recommended that the USER reviews the Privacy Notice of CETYS Universidad, which is understood as hereby attached.

If at any time the USER does not agree, totally or partially, with these TERMS OF USE, the USER shall abstain immediately from using the SITE in any of its parts or sections. THE USER agrees that various parts of the SITE may have special stipulations that, according to each case, substitute, complement and/or modify the TERMS OF USE (hereinafter the PARTICULAR CONDITIONS), whereby the USER shall, in each case, previously review each PARTICULAR CONDITION, and in the event the USER does not agree, totally or partially, with it, the USER shall abstain the use of that section of the SITE ruled by that PARTICULAR CONDITION(S). In the event that the USER uses the part of the SITE regulated by one or more PARTICULAR CONDITIONS, it will be understood that the USER will be bound totally and unconditionally to them.

OBJECT

Through the SITE, CETYS Universidad provides USERS with access to diverse information provided by CETYS Universidad or by persons directly or indirectly linked to it (hereinafter the “CONTENTS”). The USER acknowledges that the use of the SITE does not imply any right of ownership over it, any of its elements or CONTENTS. CETYS University reserves the right to modify at any time and without prior notice the presentation, configuration, information, CONTENTS and in general any part or aspect directly or indirectly related to the SITE.

 

ACCESS AND USE OF THE SITE

The access and use of the SITE by CETYS Universidad is free for USERS. The USER will be obliged to register on the SITE only when requested and under the conditions established by CETYS Universidad.

 

OBLIGATION TO MAKE CORRECT USE OF THE SITE AND THE CONTENTS.

The USER undertakes to use the SITE and the CONTENTS in accordance with applicable laws, as provided in these TERMS OF USE and with respect to public order. The USER undertakes to use the SITE and any CONTENT or aspect related to it, in a way that does not harm rights or interests of CETYS Universidad, or of persons linked to it directly or indirectly. The USER will use the SITE and/or the CONTENTS in a way that does not damage, disable or impair them totally or partially.

 

MEANS FOR OBTAINING CONTENTS

The USER must refrain from obtaining or trying to obtain information, messages, graphics, drawings, sound and/or image files, photographs, recordings, software and, in general, any kind of material accessible through the SITE or the CONTENTS. You can make use of the CONTENTS and the elements that are in the SITE using only the means or procedures established within it.

 

CORRECT USE OF THE CONTENTS

The USER undertakes to use the CONTENTS and the elements used in the SITE in a diligent, correct and lawful manner, and in particular, undertakes to abstain from: (a) using the CONTENTS in a manner, for purposes or effects contrary to the law, to the public order and to those purposes established by CETYS Universidad for the use of this SITE; (b) copy, disseminate, modify, reproduce, distribute or use the CONTENTS and the elements used on the SITE in any way, with or without profit, unless expressly authorized in writing by CETYS Universidad; (c) modify or manipulate the trademarks, logos, commercial notices, trade names and distinctive signs in general of CETYS Universidad, the SITE or persons directly or indirectly related to CETYS Universidad (unless you have their written authorization), (d) delete, evade or modify the CONTENTS and the elements used in the SITE, as well as the technical protection devices, or any mechanism or procedure established in the SITE. CETYS University declares that all the CONTENTS and the elements used in the SITE are duly registered and protected under the corresponding authorities and laws in Mexico. The USER undertakes to respect all the rights of the Intellectual Property over the CONTENTS and the elements used in the SITE of which CETYS Universidad is the owner.

 

OBLIGATION TO OBSERVE THE INSTRUCTIONS

The USER undertakes to comply with any instruction given by CETYS Universidad or by personnel authorized by CETYS Universidad that is related to the SITE, in relation to any mechanism or procedure established to use the SITE and the CONTENTS. The USER should only follow instructions given by CETYS Universidad.

 

LIABILITY FOR DAMAGES AND DETRIMENTS

The USER is responsible for any damage and / or losses of any nature caused by not complying with these TERMS OF USE or any applicable regulations, the USER releases CETYS Universidad from all civil, criminal, administrative or any other type of liability.

 

PERSONAL DATA

To use or enjoy some of the CONTENTS, it is necessary that the USER provides CETYS Universidad with certain personal data (hereinafter PERSONAL DATA) that CETYS Universidad may administer automatically or not. The USER when accessing the SITE or any of the CONTENTS in which the PERSONAL DATA is required, is authorizing CETYS Universidad to perform analysis and studies based on them. The USER undertakes to provide true and reliable PERSONAL DATA, and in case he wishes not to disclose them in the parts of the SITE that are requested, he must refrain from using that or those parts or sections of the SITE. In the event that the USER provides false or confusing information, CETYS Universidad may deny the USER access to the SITE and the CONTENTS within, without CETYS Universidad waiving any right to compensation that may be required from the USER. By providing your PERSONAL DATA on the SITE, the USER is authorizing CETYS Universidad to inform any competent authority of the respective information, in case it is requested by the appropriate legal means. CETYS Universidad will not share any personal information that has been provided, with third parties, unless it is required to provide a service or a product required by the USER.

USE OF THE SITE AND THE CONTENTS UNDER EXCLUSIVE RESPONSIBILITY FROM THE USER

By the sole fact of accessing the SITE, the USER acknowledges and accepts that the use of the SITE and of the CONTENTS, is under his exclusive and strict responsibility, for which CETYS Universidad will not be under any circumstances responsible for any flaw or problem that may present in the computer equipment (hardware) or computer programs (software) that the USER uses to access or navigate in any part of the SITE.

 

EXCLUSION OF GUARANTEES AND RESPONSIBILITIES

Exclusion of Guarantees and Liability for the Functioning of the SITE and of the CONTENTS, viruses and other harmful elements: CETYS Universidad does not control and does not guarantee the absence of viruses in the CONTENTS, nor the absence of other elements in the CONTENTS that may cause alterations in the USER’s computer system (software and / or hardware) or in the electronic documents and files stored in your computer system. The USER accepts to be solely responsible for maintaining controls and pertinent measures for the prevention of computer failures and viruses.

 

LICENSE

CETYS Universidad authorizes the USER to use the SITE exclusively under the TERMS AND CONDITIONS expressed herein, without implying that it grants the USER any license or authorization or any type of right other than the aforementioned use with respect to the “Intellectual Property” of CETYS Universidad. Understanding as “Intellectual Property” all trademarks and/or signs used in Mexico or abroad by CETYS Universidad, as well as all rights on inventions (patented or not), industrial designs, utility models, trade secrets and confidential information, commercial names, commercial notices, reservations of rights, domain names, as well as all kinds of economic rights over works and creations protected by copyright and other forms of industrial or intellectual property recognized or that come to recognize the corresponding laws.

 

DENIAL AND WITHDRAWAL OF ACCESS TO THE SITE AND / OR THE CONTENTS

CETYS Universidad reserves the right to deny or withdraw access to the SITE and / or the CONTENTS at any time and without prior notice, on its own initiative or at the request of any person, to any USER for any reason, including without limitation to those USERS that give wrongful use to the SITE, to any of its parts or sections or to the CONTENTS, or that fail to comply fully or partially with these TERMS OF USE or the PARTICULAR CONDITIONS that may be applicable.

 

DURATION AND TERMINATION

The SITE and the CONTENTS have an indefinite duration. However, CETYS Universidad may terminate, suspend or interrupt at any time and without prior notice the SITE and / or any of the CONTENTS.

 

OTHER PROVISIONS

*Shape. The USER accepts that a printed version of these TERMS AND CONDITIONS and of any communication sent and / or received electronically will be admissible as evidence in any judicial and/or administrative proceeding.

 

*Applicable law and jurisdiction. In all matters related to the interpretation and compliance with the provisions herein, by the sole fact of accessing the SITE, USERS agree to submit to the applicable laws and the jurisdiction of the competent courts in the city of Mexicali, Baja California, Mexico, renouncing any other jurisdiction that, by reason of their present or future domiciles, or for any other reason, could correspond to them.

 

INEFFECTIVE PROVISIONS

In the event that any of the TERMS AND CONDITIONS expressed herein are considered non-enforceable or declared void or invalid in accordance with the applicable legislation, this will be replaced by a term or condition that is valid and that can more strictly comply with the objective of the non-enforceable provision or that has been declared void or invalid. All other terms and conditions remain in full force.

 

RIGHTS

Any right that has not been expressly conferred on the User in this document is understood to be reserved to CETYS Universidad.
